1. Introduction

These Terms and Conditions govern the purchase of products and the use of services offered through the website www.floky.co.za, operated by Floky South Africa (Pty) Ltd (“Floky”, “we”, “us”, or “our”).

By accessing or using this website, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other applicable policies or notices displayed on our site.

Floky reserves the right to update or amend these Terms and Conditions at any time without prior notice. Any changes will take effect from the date of publication on this website.


2. Online Sales Contract

A contract of sale is concluded when a customer (“Buyer” or “Consumer”) places an order through our website and Floky confirms that order by email.

The contract is deemed to be concluded in South Africa and is subject to South African law, including but not limited to:

  • The Consumer Protection Act 68 of 2008 (CPA); and
  • The Electronic Communications and Transactions Act 25 of 2002 (ECTA).

3. Prices and Payment

3.1 All prices displayed on the website are in South African Rand (ZAR) and include VAT, unless stated otherwise.
3.2 Shipping costs and any applicable import duties or taxes (for international orders) will be clearly indicated before checkout.
3.3 Payment may be made using the secure payment methods provided at checkout, including credit/debit card, EFT, or approved third-party payment services.
3.4 Orders will only be processed once full payment has been received.
3.5 Floky reserves the right to adjust prices at any time; however, confirmed orders will not be affected.


4. Delivery

4.1 Floky delivers products to the delivery address specified by the Buyer at checkout.
4.2 Deliveries within South Africa are handled by trusted courier partners. Standard delivery times are 2–5 working days from dispatch, depending on the destination.
4.3 International delivery times vary depending on the destination country.
4.4 Floky is not liable for delays caused by couriers, customs processes, or force majeure events such as strikes, natural disasters, or transportation disruptions.
4.5 Upon receipt, the Buyer must inspect the goods for any visible damage or discrepancies and report such issues within 7 days of delivery.


5. Product Availability

All products shown on the website are subject to availability.
If an ordered item is unavailable, the Buyer will be notified and may choose between:

  • A full refund,
  • A replacement item, or
  • A store credit of equal value.

6. Risk and Ownership

Ownership of the goods passes to the Buyer only once full payment has been received by Floky.
Risk of loss or damage passes to the Buyer upon delivery of the goods.


7. Returns and Right of Withdrawal

7.1 In accordance with the Consumer Protection Act (CPA) and Electronic Communications and Transactions Act (ECTA), you may return goods within 7 working days of receipt for a full refund, provided that:

  • The product is unused, unworn, and in its original packaging; and
  • The return request is submitted within the specified time frame.

7.2 If a product is defective, damaged, or not as described, the Buyer must notify Floky within 10 working days of receiving the product.
7.3 Returns due to defects or incorrect items will be collected by Floky at no cost to the Buyer.
7.4 For exchanges or change-of-mind returns, the Buyer is responsible for the return shipping costs.
7.5 Refunds will be processed within 14 business days after the returned goods are received and inspected by Floky.

8. Customer Obligations

8.1 The Buyer agrees to provide accurate, complete, and up-to-date personal and delivery information.
8.2 It is prohibited to use false identities or third-party information when placing an order or registering on the site.
8.3 The Buyer is responsible for any delays or losses resulting from incorrect or incomplete information provided during checkout.


9. Limitation of Liability

9.1 Floky shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our website or products.
9.2 Our total liability for any claim shall not exceed the amount paid by the Buyer for the product in question.
9.3 Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act.

Floky complies with the Protection of Personal Information Act 4 of 2013 (POPIA).
Your personal data will be used only for:

  • Processing and fulfilling orders,
  • Customer service communication, and

11. Force Majeure

Floky will not be held responsible for any delay or failure to perform its obligations if such delay or failure results from events beyond its reasonable control, including but not limited to natural disasters, strikes, civil unrest, power failures, or transport interruptions.


12. Termination and Cancellation

12.1 Floky reserves the right to cancel or refuse service for any order in the event of suspected fraud, non-payment, or misuse of the website.
12.2 If an order is cancelled after payment has been made, the Buyer will receive a full refund.


13. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.
Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.
